Murder charge dismissed against Mercedes man charged in deadly home invasion

The Hidalgo County District Attorney’s Office on Wednesday moved to dismiss murder and aggravated robbery charges against a 28-year-old Mercedes man charged in a deadly 2019 home invasion.

Prosecutors filed a motion to dismiss the charges against Martin Torres Perez Jr., citing insufficient evidence, court records show.

He was charged along with Juan Jesus Hernandez, 27, and Noel Alvarado, 28, both of Mercedes, for the shooting death of 32-year-old Mercedes resident Emmanuel Alvarado on Dec. 3, 2019.

Noel is Emmanuel’s brother.

Emmanuel was killed when the men engaged in a shootout with 31-year-old Johnothon Gonzalez at a residence located at 9920 N. Saltillo Circle in rural Weslaco.

The brothers, Hernandez, Torres and Isidro Rubiel Juarez, who was 31 at the time, were attempting to rob Johnothon of drugs.

Gonzalez shot and killed Emmanuel during the shootout. He was later sentenced to 10 years probation for tampering with physical evidence.

Noel and Hernandez have pleaded not guilty to a charge of murder and two counts of aggravated robbery.

Noel is free on a $90,000 bond while Hernandez is free on a $70,000 bond.

Juarez’s whereabouts are unknown and he has a warrant for murder for his arrest.
