Pharr man convicted of shooting at San Juan police during drug raid

A Pharr man pleaded guilty to attempted capital murder the day his trial was set to start, court documents show.

Luis Guerra Garcia, 49, pleaded guilty on Monday to six counts of aggravated assault against a public servant, attempted capital murder of a peace officer, possession of marijuana and possession of a controlled substance.

Garcia was sentenced to 15 years in prison.

Garcia’s co-defendants, who include 28-year-old Brownsville resident Robert Zavala, 45-year-old Larry Palomo, 33-year-old Daniel Lee Gonzalez and 32-year-old Kayla Dee Lara, all from San Juan, are all facing similar charges.

At about 10:40 a.m. on June 16, 2023, Hidalgo County Sheriff’s Office deputies executed a narcotics search warrant at 703 Kennedy Street.

According to the probable cause affidavit, authorities announced their presence as they approached and breached the front door of the home.

As deputies entered the residence, they began to receive gunfire from the south east corner bedroom, according to the affidavit.

Investigators allege that Zavala, Palomo, Gonzalez, Garcia and Lara were inside the bedroom firing at police.

Deputies detained eight people inside the residence, but only seven were arrested.

San Juan resident Maria Isabel Bravo, 33, and Edinburg resident Gustavo Prieto, 47, were indicted along with the others late last year, but are only facing drug charges.

“Sheriff’s Investigators interviewed all parties involved and determined that Daniel Lee Gonzalez, Kayla Dee Lara, Luis Alberto Guerra Garcia, Larry Palomo and Robert Zavala were inside the south east corner bedroom where the gunshots came from,” the affidavit said.

Deputies also found a loaded shotgun, rifle and spent casings inside the bedroom.

Bravo was convicted of a possession of marijuana charge on Feb. 23, 2024, and was given four years probation. She was later arrested again for theft of property and convicted for that charge on March 28, 2024. According to jail records, she was booked on Jan. 10 on a bench warrant.

Prieto was convicted on a possession charge on July 2, 2024, and sentenced to 5 years in prison.

As for Zavala, Palomo and Gonzalez, they are scheduled for hearings on Jan. 27, Feb. 5 and Jan. 15, respectively.

Lara was out on bond on April 18 last year but was arrested once more for possession on Oct. 30. She is scheduled for a status hearing on Jan. 16.
