Mother of man killed in McAllen crash files $1M lawsuit

The mother of a 20-year-old man killed in a May 17 crash has filed a lawsuit against the suspected drunk driver and two bars she said over served the man.

Martha Angelica Abad filed the lawsuit on May 22 against Dionicio Luna Aguirre, 40, who is charged with two counts of intoxicated manslaughter, and against the NY 17th Floor and Santa Diabla bars.

“Accordingly, Plaintiff states the relief of over $1,000,000.00 in an amount to be demonstrated by the jury,” the lawsuit states.

Aguirre is accused of killing her son, Giancarlo Humberto Corriabustos, of Pasadena, and 54-year-old McAllen resident Juan Carlos Perez.

The crash happened at approximately 2:29 a.m. in the 4000 block of N. 2nd Street. Aguirre was driving a 2016 Chevrolet Silverado with Corriabustos as his passenger.

A probable cause affidavit said Aguirre ran multiple red lights after taking 17 shots and crashed into a 2015 Nissan Altima driven by Perez. Both Corriabustos and Perez died at the scene.

At the hospital, Aguirre also tested positive for THC, cocaine and amphetamines, according to the affidavit.

The lawsuit said the crash happened after Aguirre left the Santa Diabla bar “in a highly intoxicated state.” Prior to that, Aguirre had been drinking at the NY 17th Floor bar, according to the lawsuit.

The petition alleges that Aguirre was over served at both bars and that he “was obviously intoxicated to the extent that he presented a clear danger to himself and others.”

The litigation said the bars should have stopped serving him.

An initial hearing in the case has not yet been set.

As for Aguirre, he remains held in the Hidalgo County Adult Detention Center on a total of $600,000 in bonds.
