A Mission man arrested Wednesday told police he stabbed another man who he claimed was the aggressor, but video surveillance obtained contradicted his statement, according to a probable cause affidavit.

Victor Alfonso Rodriguez Jr., 21, was charged with murder after fatally stabbing Everado Alvarez.

At 10:06 p.m. on Tuesday, Mission police responded to 1115 E. 9th Street in reference to a fight.

Once there, police found two men in fighting stances and then observed one of them, Alvarez, take a few steps back and collapse, according to the affidavit.

When checked, Alvarez was found to be bleeding from a stab wound.

The other man, Rodriguez, who was with a woman later identified as Jacqueline Morales, attempted to leave in a 2023 black Chevrolet Malibu before police made contact with them.

Rodriguez went on to tell police that he observed Alvarez beating another man identified as Dionicio Ramirez.

According to Rodriguez, he stepped out of his vehicle and confronted Alvarez which then prompted him to try and fight Rodriguez by throwing a can of beer at him.

Rodriguez said he pulled a pocket knife out and pointed it at Alvarez asking him to step back several times.

“…[Alvarez] told him he had nothing to lose and that he was going after his wife (Jacqueline Morales), who was standing by the vehicle,” the affidavit said.

Rodriguez then stated that Alvarez kicked him causing Rodriguez to stab Alvarez between his stomach and chest area.

Alvarez was then transported to South Texas Health System McAllen as officers took Rodriguez’s pocket knife which was in his right boot.

Rodriguez reiterated his story when speaking to a detective and admitted to getting kicked twice by Alvarez before blocking one and stabbing him.

He added that he pulled his knife out once before concealing it again and walking away until Alvarez threatened his “girl” and pulled it out again.

The following day, detectives were informed that Alvarez died from the stab wound at 12:56 a.m.

That same day, detectives were able to obtain a surveillance video from the location. Upon review, it was learned that Rodriguez showed up confronting Alvarez wanting to fight him.

“The video shows [Rodriguez] acting aggressive while holding the pocket knife open and always advancing towards the victim,” the affidavit said. “The video also shows the victim kicking [Rodriguez] once and at said time, [Rodriguez] stabs the victim.”

According to the affidavit, Rodriguez had multiple opportunities to leave but instead chose to continue being aggressive.

Rodriguez remains jailed at the Hidalgo County Adult Detention Center on a $1 million bond.
