HARLINGEN, Texas (ValleyCentral) — A cease and desist letter has been issued by the attorney representing the family of David Zapata, a tow truck driver who was killed in a fatal crash Tuesday.
Zapata, 46, was killed while securing another vehicle onto the tow truck in the shoulder lane on eastbound expressway lanes in Harlingen.
Robert R. Flores Law Firm released a public statement addressing graphic images and videos of Zapata's lifeless body circulating on social media.
"The family has not given consent for the release, distribution, or sharing of any such material," Robert R. Flores stated.
The Flores legal team has issued a formal cease and desist notice, demanding the immediate removal of:
- Any photos or videos of Zapata relating to the crash or his fatality
- Any footage of the scene that includes his body or identifiable features
- Any posts or commentary that disclose or speculate about the nature of Zapata's passing
"These actions may also constitute violations of civil privacy laws and could give rise to legal liability," Flores stated. "If you have shared or posted any such content, please remove it immediately."
