ALTON, Texas (ValleyCentral) — A woman who was sentenced to prison for a 2022 fatal crash in downtown McAllen has filed for shock probation.
Sorely Lizeth Nino was initially sentenced to 10 years in prison and charged with intoxication manslaughter in July 2024 for her role in the crash.
The crash claimed the life of Brenda Belmontes, who authorities say was entering her car when Nino crashed into the parked vehicle.
Nino, who was 19 years old at the time of the crash, showed signs of intoxication and had a blood alcohol content level of 0.19.
Hidalgo County District Attorney Terry Palacios says anyone who is sentenced to 10 years or less is entitled to file a motion for shock probation.
Palacios says Nino must file for shock probation within 180 days of her sentencing and that her deadline is coming to a close.
"It [shock probation] must be filed by the judge who handed down the sentence. In this case, they are filing with the new judge and that judge cannot hear the case," Palacios said.
The DA says the proceeding judge is no longer employed so Nino will be limited in her options to file for shock probation.
"Either the proceeding judge must come back and hear the case or they need to request a new judge, however, because they are filing so late, the defendant is running out of time," Palacios continued.
