Port Isabel Police Chief Robert Lopez told ValleyCentral that less than seven hours before, police went to that same residence for an ambulance call, where a female claimed she had fallen and needed medical attention. The child was still alive at this point, Lopez added.

Police told ValleyCentral that Denis De La Cruz, who lived at the residence, was initially arrested on one count of assault family violence.

Jail records show De La Cruz is now facing a second count of assault causing bodily injury. Chief Lopez told ValleyCentral that he is accused of assaulting the baby's mother, as well as her 15-year-old stepdaughter.

Lopez emphasized that De La Cruz is not facing charges in connection to the baby's death as they await the results from the baby's autopsy.

De La Cruz was arraigned and his bond was set at $30,000.
