A 22-year-old Mission man is set to be arraigned Wednesday for allegedly fatally stabbing another man during a fight in late 2024.

Victor Alfonso Rodriguez Jr. has been indicted on charges of murder and aggravated assault with a deadly weapon following the death of Everado Alvarez on Nov. 13, 2024, according to court records.

At 10:06 p.m. that day, Mission police responded to 115 E. 9th Street in reference to a fight, according to a probable cause affidavit.

Police found two men in fighting stances and then saw one of them, namely Alvarez, take a few steps back and collapse.

When police checked him, they found that Alvarez was bleeding from a stab wound.

Rodriguez, who was with a woman later identified as Jacqueline Morales, attempted to leave the scene in a 2023 black Chevrolet Malibu before police officers made contact with him, according to the affidavit.

He told police that he saw Alvarez beating another man identified as Dionicio Ramirez, so he stepped out of his vehicle and confronted Alvarez, which then prompted him to try and fight Rodriguez after throwing a can of beer at him.

Rodriguez said he pulled out a pocket knife and pointed it at Alvarez and asked him to step back several times.

“… (Alvarez) told him he had nothing to lose and that he was going after his wife (Jacqueline Morales), who was standing by the vehicle,” the affidavit said.

Rodriguez went on to say that Alvarez started kicking him causing Rodriguez to stab Alvarez between his stomach and chest area.

Alvarez was taken to South Texas Health System McAllen while police officers searched Rodriguez and found his pocket knife in his right boot.

Rodriguez reiterated his story and admitted to getting kicked twice by Alvarez before blocking one and stabbing him when speaking to a detective, adding that he pulled his knife out once before concealing it and walking away until Alvarez threatened his “girl,” causing him to pull out the knife again.

Detectives were later informed that Alvarez died from the stab wound at 12:56 a.m. the following day, according to the affidavit.

That same day, detectives obtained surveillance video from the location and learned that Rodriguez showed up confronting Alvarez wanting to fight him.

“The video shows (Rodriguez) acting aggressive while holding the pocket knife open and always advancing towards the victim,” the affidavit said. “The video also shows the victim kicking (Rodriguez) once and at said time, (Rodriguez) stabs the victim.”

According to the affidavit, Rodriguez had multiple opportunities to leave but instead chose to continue being aggressive.

Rodriguez was released from jail on Nov. 25, 2024 on a $50,000 bond, jail records show.
