MCALLEN, Texas (ValleyCentral) — Police have arrested a fifth person in connection to a public sexual performance at a McAllen nightclub, according to a court document.
Javier Gallegos was arrested and charged with public lewdness for the performance that took place at Santa Diabla on August 4.
Four previous arrests were made in relation to the performance, including a performer who allegedly had sex with multiple people on the dance floor of Santa Diabla, a McAllen night club.
Court documents say a performer, identified as Diego Rodrigo Barros, had multiple videos from the night he performed at the nightclub
Investigators identified Gallegos through these videos that show him and Barros having sex, according to the document.
Authorities contacted Gallegos who agreed to meet with investigators to discuss the case.
Shortly before he was scheduled to meet with investigators, Gallegos declined to provide a statement as per his attorney, according to the court document.
Police continue to investigate the case.
Gallegos was released from jail Sept. 18 on a $10,000 bond.
