Documents reveal lone survivor of McAllen crash tested positive for substances at hospital

MCALLEN, Texas (ValleyCentral) — Documents obtained by ValleyCentral revealed Dionicio Luna Aguirre, the man accused of killing two men in a drunken crash, tested positive for multiple substances when tested at the hospital.

Aguirre is charged with two counts of intoxication manslaughter with a vehicle for the deaths of 54-year-old driver Juan Carlos Perez and 20-year-old Gianncarlo Humberto Corria Bustos.

Documents revealed the details of the crash.

Aguirre was driving a white 2016 Chevrolet Silverado after leaving a bar after closing time. Perez, the driver of a white 2015 Nissan Altima was traveling westbound on Nolana Avenue with a green traffic signal.

Simultaneously, Aguirre was traveling northbound on N. 2nd street at a "high rate of speed" and "entered the intersection at Nolana Avenue against a red traffic signal and struck Mr. Perez's vehicle."

Both vehicles sustained major damage and were reported to be inoperable.

Perez and Corria Bustos, Aguirre's passenger, were both pronounced dead at the scene.

"Additional video footage from the Milestone system shows the Chevrolet Silverado disregarding multiple red traffic signals at various intersections prior to the collision, while traveling at a high rate of speed," the documents state.

An officer who responded to the scene said they saw Aguirre exit the truck and detected a strong odor of alcohol coming from his breath. The lone survivor of the crash was taken to the hospital for medical evaluation, where it was discovered that he tested positive for cocaine, THC and amphetamines.

Aguirre allegedly told hospital staff that he had consumed "17 shots" while out with Corria Bustos.

The report stated that a review of Corria Bustos' social media shows him and Aguirre consuming alcoholic beverages at a bar in the McAllen Downtown District prior to the crash.
