On April 15, McAllen police officers were working an "online undercover detail" on several social media networking sites. One of the personas used in the investigation was "Kayla Morales," a 14-year-old girl.

According to a probable cause affidavit, an account named "Activo" initiated a conversation with "Kayla Morales," on an undisclosed social media site. The user was later identified as Gutierrez.

A "lengthy conversation" took place, in which Gutierrez was informed that "Kayla Morales," was 14 years old, the document stated.

"During the conversation, [Gutierrez] made arrangement to meet for the purpose of sex and also sent a photo of what he looks like," the affidavit stated.

Marked and undercover units were staged at the 1200 block of N. 12th Street where authorities agreed to meet Gutierrez. Gutierrez said he would be driving a Honda and wearing a red shit.

When Gutierrez arrived, he was taken into custody. At the police station, Gutierrez was shown a print out of the conversation between the two, and admitted to communicating with that account.

"[Gutierrez] admitted he was told he was communicating with a 14 year old, whom he made arrangements to meet up for the purpose to have sex," the document stated.

Gutierrez was booked into the Hidalgo County Jail on Tuesday. His bond was set at $50,000, and he remains jailed as of Thursday.
