At 4:44 p.m. June 3, police responded to the H-E-B on S. Closner Blvd. to take a report of a runaway. An officer spoke with a woman, who is the legal guardian of her 14-year-old grandson.

The woman said her grandson had ran away without her permission and believed he went to a park to meet with Montenegro. An officer found the child and Montenegro at Cenizo Park on West Prague Street while "embracing one another," a probable cause affidavit stated.

The grandmother told detectives that she met Montenegro the previous night, June 2, when her grandson introduced him at their home as his boyfriend.

"[The woman] asked [Montenegro] how old he was and he advised that he was 19 years old," the affidavit stated.

She told Montenegro that her grandson was only 14 years old, and told him he needed to leave the home and stop all contact with him.

A detective then spoke with Montenegro, who admitted that the woman told him the boy was 14, but stated he did not believe her. Montenegro added that he kissed the boy, left him a hickey on his neck and sent him explicit images, the affidavit alleges.

The boy told detectives that he met up with Montenegro at Jaycee Park on June 2, and they engaged in sexual contact.

The detectives followed up with the boy at the Children's Advocacy Center, where he said that Montenegro began speaking to him on TikTok on May 2, then used other applications to continue communicating.

The affidavit stated that Montenegro spoke to the child about making out, having sex and having a future together.

Montenegro was booked into the Hidalgo County Jail on July 15, and his bond was set at $110,000. Records indicate that he remains jailed as of Monday.
