DA seeks death penalty for accused shooter in drug deal gone wrong

DONNA, Texas (ValleyCentral) — Hidalgo County District Attorney Toribio 'Terry' Palacios is seeking the death penalty for a Donna man accused of fatally shooting a teenager in what authorities have called a drug deal gone wrong.

Geoffrey Jay Luna, 28, was charged with capital murder by terror after critically injuring a 16-year-old boy who later died of his injuries in January.

Luna was also charged with two counts of aggravated assault with a deadly weapon and aggravated robbery.

"We are seeking the death penalty on that case based on his prior arrests," Palacios told ValleyCentral.

Hidalgo County Jail records show Luna's record dates back to 2013.

Luna's juvenile history shows charges of aggravated robbery, aggravated assault, and deadly conduct.

"He keeps doing aggravated robberies or aggravated assaults," Palacios continued. "Now he has actually finished this. Now he has murdered."

Geoffrey's older brother, Leeroy, 32, was also arrested for his involvement in the fatal shooting.

Leeroy was also charged with capital murder, two counts of aggravated assault with a deadly weapon, and aggravated robbery.

However, the state is not seeking the death penalty for Leeroy.

"Leeroy has a different criminal history," Palacios said.

Records show Leeroy had one charge of theft of property two months before his arrest for the deadly drug deal shooting.

Both brothers remain in Hidalgo County Jail on their respective bond amounts.

Geoffrey was issued a bond of slightly more than $2 million.

Leeroy was issued a $1.3 million bond.
