‘Belligerent’ Edinburg man accused of killing cyclist indicted

An Edinburg man accused of hitting and killing a cyclist in 2023 is scheduled to be arraigned Tuesday on an indictment charging him with intoxication manslaughter.

Alan Nicolas Rios, 20, is also charged with accident involving death. He is accused of killing 36-year-old Amilcar Gomez.

At around 11 p.m. on July 9, 2023, the Texas Department of Public Safety received a call in reference to a white SUV that hit a cyclist, according to a probable cause affidavit.

Once there, police found Gomez unresponsive and he was pronounced dead at 12:02 a.m. following the arrival of Medcare EMS personnel.

One eyewitness described the suspect vehicle as a 2001 Chevrolet Tahoe which was later located near the scene at the intersection of Alamo and Texas roads.

“Damage consistent with evidence found at the crash scene was observed on the vehicle,” the affidavit said. “A passerby recognized the crash vehicle as his son’s.”

Rios’ dad led troopers to his residential area where Rios was found walking near the roadway where he was detained.

He was then transported back to the scene of the crash for an interview where he appeared confused and “would become agitated sporadically,” the affidavit said.

Rios’ eyes were red and bloodshot, his speech was slurred and he was emitting a “strong odor” of an alcoholic beverage, according to the affidavit.

“Mr. Rios’ balance was unsteady,” the affidavit said. “Mr. Rios was belligerent and argumentative with officers at the scene without provocation.”

Due to his behavior and lack of cooperation, a standardized field sobriety test couldn’t be conducted.

Rios was then placed under arrest and transported to the South Texas Health System for medical treatment and a blood draw.

Rios was released from custody on July 27, 2023 on $125,000 in bonds.
