AG opinion sought over release of affidavit in Donna teen’s murder

The Hidalgo County Sheriff’s Office is asking the Texas Attorney General’s Office whether it can withhold the probable cause affidavit for a 32-year-old man charged in the fatal shooting of a Donna teen.

The Monitor filed a Texas Public Information Act request with the sheriff’s office on March 21 seeking a copy of the affidavit for the arrest of Leeroy Luna.

Leeroy Luna is charged along with Geoffrey Luna, 28, of Donna, in the fatal Jan. 16 shooting of a 16 year old in what the sheriff’s office said previously was a drug deal gone wrong.

The unidentified teen was shot multiple times, according to the sheriff’s office.

In its request, civil attorneys with the Hidalgo County District Attorney’s Office cite Texas Family Code in its request to withhold the affidavit.

The attorneys say in a brief that because the victim was a minor, the affidavit should not be made public.

The shooting investigation began that day at around 8:08 p.m. after deputies responded to the 1900 block of Walker Road in Donna at the request of a Hidalgo County Precinct 1 constable.

The constable reported that they had engaged in a pursuit of a gray Jeep Cherokee driven by a man “covered in blood.”

The driver told authorities he had just dropped off his 16-year-old brother at the Alamo Freestanding Emergency Room after he was shot.

Geoffrey Luna was arrested on Jan. 17 while Leeroy Luna was arrested in Columbus, Kansas on March 6. He was booked into the Hidalgo County Adult Detention Center on March 20 where he remains held on a $1 million bond on a capital murder charge.

Geoffrey Luna, meanwhile, remains jailed on $1 million in bonds on two counts of aggravated assault with a deadly weapon.

He has no bond on a charge of capital murder and is also being held on a parole warrant.

The men have not yet been indicted.
