School employee accused of faking injury for workers' comp

RIO GRANDE CITY, Texas (ValleyCentral) — A Rio Grande City Grulla Independent School District employee was arrested after allegedly faking an injury and filing a report for workers' compensation, documents show.

Yadira Montalvo was arrested on a charge of fraud to obtain workers comp, according to a probable cause affidavit.

On Dec. 15, an RGC ISD police department investigator met with a district official, who told him that an employee, identified as Montalvo, had filed an accident report claiming she had fallen while crossing an opening on the sidewalk near the Curriculum Office, the document stated.

The official told the investigator there was surveillance footage that contradicted that statement.

According to the affidavit, the video showed Montalvo walking away from the building and crossing an opening on the sidewalk with "minimum difficulty."

"Upon her return, Yadira Montalvo deliberately pauses, looks around and positions herself to appear as if she had fallen into the opening on the sidewalk," the affidavit stated.

According to the document, Montalvo then placed both feet into the opening, threw a dollar bill and glasses in front of her and signaled for help.

School nurses responded to the scene and Montalvo filed an injury report claim with the school district. The affidavit stated that the incident was reported to Workers' Compensation during working hours and Montalvo required an examination at a clinic, resulting in a $379.09 payout for her claim.

On April 2, Montalvo was arrested and booked into the Starr County Jail.
